Welcome to Split Rail Sod Manager. These Terms and Conditions ("Terms") govern your use of our services. By accessing or using our service, you agree to be bound by these Terms. If you do not agree, do not use our service.

1. Acceptance of Terms

By creating an account, placing an order, or otherwise using our service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

2. Use of Service

You agree to use the service only for lawful purposes and in accordance with these Terms. You may not use the service to violate any laws, infringe on the rights of others, or transmit harmful or offensive content. We reserve the right to suspend or terminate access for conduct we deem inappropriate.

3. Accounts

Where an account is required, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Orders and Payments

Orders are subject to acceptance and availability. Prices and availability are subject to change. You agree to pay all charges incurred in connection with your orders in accordance with the pricing and payment terms presented at the time of order. We may use third-party payment processors; their terms may also apply.

5. Delivery and Performance

Delivery times and methods are as described at the time of order or as otherwise communicated. We are not liable for delays or failures due to circumstances beyond our reasonable control.

6. Termination

We may suspend or terminate your access to the service at any time, with or without cause or notice. You may stop using the service at any time. Provisions that by their nature should survive termination will remain in effect.

7. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, Split Rail Technologies and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the service or these Terms. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Split Rail Technologies and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service or violation of these Terms.

10. Governing Law

These Terms shall be governed by the laws of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Idaho.

11. Changes

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the service after such changes constitutes acceptance of the revised Terms.

SMS Program Terms

This section applies to our SMS text messaging program and is provided to comply with US carrier and industry (CTIA) requirements for SMS programs. By opting in to SMS messages from Sod Manager, you also agree to these terms.

  1. Split Rail Sod Manager – You may receive SMS messages from us for order updates, delivery notifications, account alerts, and related service communications.
  2. Opt-out (STOP): You can cancel the SMS service at any time. Text "STOP" to the number from which you receive messages. After you send "STOP," we will send you an SMS to confirm that you have been unsubscribed. After that, you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time and we will start sending SMS messages to you again.
  3. Help: If you are experiencing issues with the messaging program, reply with the keyword HELP for more assistance, or contact us directly at legal@splitrail.tech or 3546 N 45th E, Idaho Falls, ID 83401.
  4. Carriers are not liable for delayed or undelivered messages.
  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
